Agile Off Road Release of Liability & Product Safety Warning

By purchasing, installing, using, or allowing the installation of products sold or manufactured by Agile Offroad (“Agile Offroad,” “Company,” “we,” “our,” or “us”), the customer, vehicle owner, installer, and/or end user acknowledges and agrees to the following terms:

RELEASE OF LIABILITY

The undersigned hereby fully releases, waives, discharges, and forever holds harmless Agile Offroad, its owners, officers, employees, agents, affiliates, successors, assigns, dealers, distributors, contractors, installation partners, and representatives from any and all claims, liabilities, demands, damages, actions, causes of action, losses, costs, expenses, or suits of any kind whatsoever, whether known or unknown, anticipated or unanticipated, arising directly or indirectly from:

  • Products sold by Agile Offroad
  • Products installed by Agile Offroad
  • Products installed by third-party shops or installers
  • Products installed by the vehicle owner or end user
  • Online product sales
  • Vehicle modifications
  • Suspension modifications
  • Off-road use
  • Installation procedures
  • Technical instructions or manuals
  • Product recommendations or guidance

This release includes, but is not limited to:

  • Vehicle damage
  • Mechanical failure
  • Loss of vehicle control
  • Property damage
  • Personal injury
  • Death
  • Economic loss
  • Loss of use
  • Towing expenses
  • Labor costs
  • Business interruption
  • Any consequential or incidental damages

The customer acknowledges that aftermarket automotive products and vehicle modifications inherently involve risk and may affect vehicle handling, braking, stability, ride quality, safety systems, fuel economy, and overall vehicle performance.

The customer voluntarily assumes all risks associated with the purchase, installation, operation, maintenance, and use of modified vehicles and aftermarket products.

PRODUCT SAFETY WARNING

Agile Offroad strongly recommends that all products be installed by qualified and certified automotive professionals experienced with suspension systems, steering systems, braking systems, electrical systems, and vehicle modifications.

Failure to properly install, inspect, maintain, or operate modified vehicles may result in:

  • Vehicle instability
  • Reduced braking performance
  • Increased stopping distance
  • Loss of vehicle control
  • Rollover accidents
  • Serious injury or death

Lift kits, suspension modifications, oversized tires, wheels, roof racks, recovery equipment, heavy loads, and aftermarket accessories may raise the vehicle’s center of gravity and alter handling characteristics both on-road and off-road.

Drivers must use extreme caution during:

  • Off-road driving
  • Emergency maneuvers
  • High-speed driving
  • Towing
  • Uneven terrain operation
  • Heavy load conditions

The vehicle owner is solely responsible for informing all drivers and passengers of the modified driving characteristics and risks associated with the vehicle.

INSTALLATION & PRODUCT USE RESPONSIBILITY

Agile Offroad products are designed for vehicles that may be subjected to severe-duty, off-road, overlanding, towing, commercial, and high-performance driving conditions that exceed those anticipated by the original vehicle manufacturer.

Because operating conditions vary greatly and are outside Agile Offroad’s control, the customer acknowledges that:

  • Product lifespan may vary
  • Increased maintenance may be required
  • Components may wear faster under extreme use
  • Regular inspections are necessary to maintain vehicle safety

The customer accepts full responsibility for:

  • Routine maintenance
  • Torque inspections
  • Alignment verification
  • Safe operation
  • Compliance with local laws and regulations
  • Periodic inspection of all aftermarket components

Do not purchase, install, or use Agile Offroad products unless you are willing to accept full responsibility for vehicle maintenance, inspection, and safe operation.

INSTALLATION MANUALS & TECHNICAL DOCUMENTS DISCLAIMER

Installation manuals, videos, technical guides, diagrams, and instructions provided by Agile Offroad are intended solely as general reference materials.

Agile Offroad does not guarantee:

  • Accuracy for every vehicle configuration
  • Compatibility with all modifications
  • Completeness of instructions
  • Suitability for all installations
  • Specific performance outcomes

Vehicle conditions, previous modifications, aftermarket accessories, manufacturing tolerances, and installer skill levels may affect installation procedures and results.

Agile Offroad shall not be liable for damages or injuries resulting from reliance on installation manuals, videos, or technical documentation.

VEHICLE HEIGHT & LEGAL COMPLIANCE

Vehicle modification laws vary by state, county, and municipality, including regulations related to:

  • Vehicle height
  • Tire coverage
  • Lighting
  • Suspension modifications
  • Fender requirements
  • Emissions compliance

It is solely the vehicle owner’s responsibility to ensure compliance with all applicable laws and regulations.

PRODUCT CHANGES & SPECIFICATIONS

Agile Offroad reserves the right to change product designs, materials, finishes, specifications, instructions, or manufacturing processes at any time without notice and without obligation to modify previously manufactured or sold products.

GOVERNING LAW

This Release of Liability and Product Safety Warning shall be governed by and construed in accordance with the laws of the State of California.

Any disputes arising from the use, purchase, installation, or operation of Agile Offroad products or services shall be subject to the exclusive jurisdiction of the courts located in California.

By purchasing, installing, or using Agile Offroad products or services, the customer acknowledges that they have read, understood, and voluntarily agreed to the terms contained in this Release of Liability & Product Safety Warning.
